What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy allows people to erase qualifying debt by selling or liquidating their valuable assets. Some debt can be discharged, but other debts are non-dischargeable and require a payment plan. These debts include:
- Taxes
- Domestic support obligations
- Student loans
- Restitution from a criminal conviction
- Judgment from a personal injury lawsuit
Many clients are worried about whether they will lose their house or car. There is not black and white answer to this. If you drive a Hummer or a Lamborghini, those items will probably be sold to pay your creditors. Other extravagant personal items, such as airplanes, fine jewelry or antiques, will also be sold to get rid of debt.
