Wage Garnishments
If you are having your wages garnished because you are in financial trouble, I can help you understand what options are available. You might be eligible to file for bankruptcy, or it might make more sense to negotiate with your lenders. If you file for bankruptcy, wage garnishments will stop. Depending on when the wages were garnished, it is possible they will be returned.
Foreclosures
Many people come to me with a letter from a lawyer who is threatening foreclosure if they do not pay the amount that is past due on their mortgage. Some people come to me if they have a summons to appear in court because their mortgage holder plans to foreclose and is asking the court to sell the property to pay the balance owed on the mortgage. I sit down with clients and help them figure our a solution for their situation.
Liable for Deficiencies
If a property is foreclosed, sold at auction and the amount of money recovered is not enough to pay the mortgage, then the lender can go after the debtor for the deficiency of the mortgage.
Filing Chapter 7 bankruptcy eliminates this deficiency and the debtor's responsibility to pay it. This applies to homes that have been foreclosed and resold at auctions and to cars that have been repossessed and resold for less than what the debtor owes on it.
